Trademarks

You’ve invested time, money, and creativity into your brand — the last thing you need is someone else owning the name you worked hard to build. Trademarks give you the exclusive legal right to your business name, slogans, and logos so you can scale confidently and avoid costly rebrands.

You Need a Trademark If…

You’re launching a business, offer, or product

You’re obsessed with your brand name or slogan

You’ve invested in branding, websites, or marketing

You’re worried competitors might copy your ideas

You plan to sell your business one day

You want to scale with peace of mind

THE TRUE VALUE OF A TRADEMARK

Why do I need a trademark?

Because without one, your brand isn’t legally yours.

Watch the brief video below to get the full explanation of why a trademark is such a valuable asset to have as a business owner.

A trademark gives you the exclusive right to use your business name, course name, podcast title, slogan, or logo in all 50 states. It’s the only legal protection that ensures no one else can profit from, confuse, or copy the brand you’ve worked so hard to build.

Your LLC doesn’t do that.
Your domain name doesn’t do that.
Your Instagram handle definitely doesn’t do that.

Those things help you show up, but only a federally registered trademark gives you true ownership and legal backing to protect it.

Without it? You risk:

Forced rebrands after investing in design, content, and marketing

Copycats diluting your reputation and confusing your audience

Losing the ability to scale or license your brand down the line

Whether you’re launching a signature offer, building brand equity, or simply tired of looking over your shoulder—this is how you claim your name and protect your growth.

Trademarks aren’t just for big brands. They’re for founders, creators, and industry leaders who are building something worth protecting—and who don’t want to wake up one day being told they have to change the name they’ve already invested in.

How it works

We don’t just file trademarks.

We give you strategy, clarity, and protection—at every step.

HERE'S WHAT TO EXPECT:

Step 1: Brand Discovery Questionnaire

You’ll start by completing a short, strategic questionnaire about your business and the name, phrase, or logo you want to trademark.

This gives us everything we need to conduct a comprehensive legal search with context—not just keywords.

Step 2: Full Trademark Clearance Search

Before you invest in branding, we help you avoid legal landmines.
We’ll conduct a full clearance search that includes:
→ Federal trademark databases (USPTO)
→ State trademark records
→ Common law uses (including websites, social media, and domains)

Our goal: Identify any existing marks that could create a risk of refusal—or a future legal conflict.

Step 3: Opinion Letter + Strategy Guidance

You’ll receive a comprehensive report outlining:
→ Any potential conflicts or risks
→ Whether your mark is high or low risk
→ The best strategy for moving forward
→ Our recommended class(es) to protect your goods/services

You’ll receive this within 7–10 business days of submitting your questionnaire.

Have questions? A complimentary consultation with our lead attorney is included to walk you through the results and options.

Step 4: Application Filing

We prepare and file your trademark application with the USPTO—including all strategy-backed decisions and legal nuances.

No guesswork. No missed boxes.

Just a clean, professional application filed by a team with hundreds of successful trademarks under our belt.

Step 5: Office Actions + Ongoing Application Support

If the USPTO issues an Office Action (a formal response or objection), we’ll respond on your behalf.

→ For low-risk applications, we include responses to both non-substantive and substantive Office Actions at no additional charge.

Your application stays on track, with no hidden fees or surprises.

Step 6: Registration + Long-Term Protection

Once your trademark is registered, you own the exclusive rights to that name, phrase, or logo in all 50 states.

We’ll:
→ Track your renewal deadlines (at no extra cost)
→ Offer optional Trademark Monitoring to keep an eye on new filings that may infringe on your rights
→ Support your growth with licensing, enforcement, or expansion strategies as needed

Most Businesses Have More Than One Trademark

Your business name is just the beginning.

If you’re launching, scaling, or building a brand ecosystem, you likely have multiple pieces worth protecting:

Program and course names

Signature offers and taglines

Podcast titles and digital products

Logo variations or sub-brands

Every one of these could be a separate trademark—and if it’s part of your brand identity, it deserves protection.

“When I reached out to Berkley about trademarking my name for my copywriting business, I had little to no idea of what the trademarking process would look like. She was the first lawyer I reached out to (after stalking nearly half of all business attorneys to exist) and I immediately felt at ease. She is SO knowledgeable, down to earth, and cares about your business like it’s her own. If I could register one million trademarks with her, I would! Choosing Berkley and her team was the best decision I could have made for my brand. Just do it!

What You Need to Know

What is a trademark?

Any word, phrase, or design that identifies the source of your goods or services.

Watch the video for a more detailed explanation.

Trademarks protect any word, phrase, or design that identifies the source of your goods or services. While copyright protects any original work of authorship, like the contents of an ebook or the videos in a course.

Yes. The moment your brand name is tied to a service, digital offer, podcast, event, or product—especially if it’s your signature thing—it becomes intellectual property. You don’t need a storefront or a huge brand to justify protecting your name. You just need a business that’s growing.

Absolutely. These are some of the most commonly trademarked assets in the online space. If it has a distinct name and people associate that name with your brand, it can often be protected—especially if you’re using it for ongoing offerings or intend to scale.

Yes. Trademarking is about securing the future of your brand, not just reflecting your current size. If you plan to grow, license, sell, scale, or protect your reputation, filing early gives you peace of mind—and legal leverage—as you expand.

You can trademark a name as soon as you have a good-faith intent to use it—ideally before you launch. There are two types of trademark applications: one for before you start using a mark, and one when you’re already using it in connection with your goods or services. The sooner the better, but it’s never too late—unless someone else registers a similar name first.

You can start using your name right away, but it’s safest to file as early as possible—ideally before launch. Otherwise, you could unknowingly infringe on someone else’s trademark and be forced to rebrand later.

You can, but it’s not recommended. The USPTO is a legal system, not a form-filing service. There are legal strategies, class selections, and evidentiary rules that trip up non-attorneys every day. Mistakes can cost you time, money, and even your rights.

No. Each word, phrase, or design is its own application. Each logo variation is also treated as a separate trademark—even small changes in layout or design are considered different marks.

No. Forming an LLC only prevents someone else from registering the same business name in your state. It does not give you nationwide rights to your brand. Only a federal trademark does that.

Social handles and domains don’t determine trademark rights. What matters is whether someone is already using that name in your industry. That’s why a legal clearance search is essential.

They will likely own the legal rights to that name, and you could be forced to rebrand—even if you’ve been using it publicly longer.

On average, about 14 months or more. However, the day you file is the day you gain priority to the name in the eyes of the USPTO. We begin work as soon as you book so your place in line is secured as quickly as possible.

A trademark can last indefinitely as long as it’s properly maintained and used. The USPTO requires periodic renewals, but your rights don’t expire as long as those are filed and the mark stays in use.

Be careful. Many filing services are not attorneys and operate like high-volume trademark factories. It often costs more to fix a bad filing than to do it right the first time. Experienced trademark attorneys typically charge between $2,000–$5,000 for proper protection.
